1. Agreement to terms

1.1 Welcome to this website at aviation.govt.nz, the website hosted by the Civil Aviation Authority of New Zealand (CAA, we, our, us).

1.2 When we use the terms you and your, we are referring to any person or organisation that accesses this site.

1.3 Having a MyAviation account does not remove your legal obligations under the Civil Aviation Act 1990 (Act) and Civil Aviation Rules (CARs). To find out more about your obligations under the Act and the CARs visit Civil Aviation Act 1990(external link).

1.4 By accessing and using this site, you are agreeing to be bound by these terms of use.

1.5 If you are using this site on behalf of a business, government agency or other legal entity (each a Business), you are accepting these Terms on behalf of that Business and you represent and warrant to us that you are authorised to do so.

1.6 We may change the content on MyAviation from time to time.

1.7 We may change these Terms of Use from time to time and will post any such changes on this page.

1.8 Continuing to use MyAviation after the changes will be considered as acceptance of the changed Terms of Use. If you have questions about the Terms of Use please get in touch.

1.9 MyAviation may not be available at all times. If this means you can’t complete a required task you can contact us through our online form.

2. Access and login security

2.1 To access MyAviation, you need to register for an account and then log in with your username and password.

2.2 You are responsible for selecting a secret and strong password and for maintaining the security of your username and password. You must also provide any other information (such as your email address) that we request to complete the registration process and you must keep these details up to date. Fictitious entries are not permitted.

2.3 We may email or send SMS messages to you directly. For example, you may be sent:

      • 2.3.1 Activation codes or temporary login for MyAviation (when you request these),

      • 2.3.2 Information about the MyAviation web application,

      • 2.3.3 Security notifications,

      • 2.3.4 Information about changes to the law or policy changes, or

    • 2.3.5 Notifications to sign in to MyAviation to complete a task.

2.4 You can update your contact details at Change of address. By accepting these Terms of Use, you agree that the CAA may use the settings in place at that time.

2.5 Your username and password are personal to you. You are not permitted to share them with others. If you think someone knows your login information, you must immediately:

    • 2.5.1 Change your password, and

    • 2.5.2 Let us know through our online form.

2.6 Make sure that you log out of your MyAviation session once you are finished.

2.7 We may suspend or disable your access to this site if we consider it necessary for security reasons or if you breach these terms.

3. Our content and your use of it

3.1 Unless otherwise indicated, we or our licensors are the owners of the intellectual property rights in this site and the content on this site. You may not use our intellectual property rights and content unless authorised to do so under these terms or by us in writing.

3.2 For permission to reproduce information on this website for any purpose other than personal use, please contact the CAA by emailing info@caa.govt.nz.

4. Indemnity

4.1 You agree to indemnify us and keep us indemnified against all liabilities, damages, losses, costs and expenses (including legal expenses) suffered or incurred by us and arising as a result of any breach by you of any of these terms. This clause does not apply to departments and departmental agencies of the Crown and their staff or to Crown entities and their staff. It also doesn’t apply if we waive its application to you in writing.

5. Disclaimer

5.1 We endeavour to take care in our maintenance of this site. You agree, however, that we will not be liable to you, on any legal basis (including negligence), for any loss or damage you suffer through your use of this site, its content or any website to which it is linked, except in those cases where the law does not allow us to exclude or limit our liability to you.

5.2 We make no warranty or representation as to continuity of service and reserve the right to suspend, terminate or otherwise alter access to some or all of the site's content or services at any time and without notice.

5.3 Nothing on this website should be construed as legal advice. If you require legal advice, it is your responsibility to obtain it from an appropriately qualified lawyer.

6.1 Our treatment of your personal information is described in our privacy statement. In agreeing to these terms of use or using our site, you will be taken to have read and agreed to the terms of that privacy statement.

6.2 We have systems and procedures in place to prevent loss, unlawful access, use, modification, disclosure or other misuse of your information, consistent with good practice and as required by relevant law and policy. Care has been taken to make sure that only certain people with specific roles and authorised access levels are able to view your identity and transaction-related information.
